These Terms of Service (“Terms”) govern access to the website and services offered by MADISON SILVERECHO COMMERCE LLC (“Company,” “we,” “us,” or “our”). By using the website or purchasing a service, you agree to these Terms and any written service-specific terms provided before an engagement.

1. Service scope

We provide general nutrition consulting, meal-planning guidance, nutrition education, weight-management support, and wellness coaching. Specific deliverables, scheduling, format, pricing, and duration may be confirmed separately in writing.

2. Educational and wellness services

Website content and Company services are for general educational and wellness purposes. They do not constitute medical advice, diagnosis, treatment, psychotherapy, emergency services, or medical nutrition therapy. Information is not a substitute for care from a physician, registered dietitian, mental-health professional, or other appropriately licensed provider.

Seek qualified medical care for symptoms, medical conditions, pregnancy-related needs, medication questions, eating disorders, or therapeutic diets. Call 911 or the appropriate emergency service for an emergency.

3. Client responsibilities

You are responsible for providing accurate relevant information, asking questions when recommendations are unclear, making your own decisions, and consulting licensed providers where appropriate. Results vary and depend on many factors outside the Company’s control. No particular outcome is promised or guaranteed.

4. Appointment requests and communication

A website submission is a request, not a confirmed appointment. An appointment is confirmed only after written acceptance from the Company. Do not send urgent or sensitive medical information through the website or ordinary email.

Rescheduling, cancellation, late-arrival, and no-show expectations will be communicated when an appointment is confirmed. Service-specific written terms control if they differ from this general section.

5. Fees, payment, and refunds

Applicable fees, payment timing, and refund conditions will be disclosed before purchase or confirmation. Unless otherwise stated in writing, completed services and delivered customized materials are nonrefundable to the extent permitted by law.

6. Website content and intellectual property

Website text, branding, layouts, original educational materials, and other Company content are owned by or licensed to the Company and protected by applicable law. You may use publicly available educational content for personal, noncommercial purposes. You may not reproduce, sell, publish, or create commercial derivative materials without written permission.

7. Acceptable use

You agree not to interfere with website security or operation, submit unlawful or harmful material, impersonate another person, attempt unauthorized access, scrape the website at unreasonable volume, or use the website to violate applicable law.

8. Third-party links and services

The website may link to or embed third-party services. We do not control and are not responsible for their availability, terms, privacy practices, accuracy, or content.

9. Disclaimers and limitation of liability

The website and general content are provided “as is” and “as available” to the extent permitted by law. We disclaim warranties not expressly provided in a signed writing. To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages arising from website use or reliance on general educational content.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Any dispute will be handled in a court with appropriate jurisdiction in Kentucky, unless applicable law requires otherwise.

11. Changes and severability

We may update these Terms by posting a revised version and effective date. If any provision is found unenforceable, the remaining provisions will continue in effect.
